Terms of Service

General

The following agreement (“Agreement”) is entered into between you (“Client”) and Callin N Fallin Outfitters LTD (herein CNFO), a Canadian corporation having a business at 537 7th Street South Lethbridge, Alberta, Canada T1J2G8, and is made effective on the date of the electronic acceptance. This agreement sets forth the terms and conditions that govern the products and services (collectively, known as the “Services”) provided by CNFO.

Your electronic acceptance signifies that you have read, understood and agreed to be bound by the terms and conditions of this Agreement and that by such acceptance you agree that any previous agreements between you and CNFO will be terminated and superseded by this Agreement.

CNFO, in its sole and absolute discretion, may change or modify this Agreement, and the corporate policies and/or Service Specific Terms which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon the (ii) your continued use of the Services after CNFO posts the amended Agreement to CNFO.

Eligibility

The Services found at this Site are available only to Clients who can form legally binding contracts under applicable law. You represent and warrant that you are (i) at least eighteen (18) years of age and/or (ii) otherwise recognized as being able to form legally binding contracts under applicable law. You further represent and warrant that you are not on the United States Department of Treasury, Office of Foreign Asset Controls list of specially designated National Blocked Persons and are not otherwise a person to whom CNFO is legally prohibited to provide the Services.

Payments

In consideration of the services provided by CNFO, the client or clients shall pay to CNFO fees according to the payment schedule set forth on the website and Terms Of Service, as well as the client/outfitter agreement. CNFO accepts all major credit cards, debit cards, PayPal, and electronic wire transfers. CNFO does allow one client to be the group coordinator. If this is the case, the group coordinator, who is paying for members of the group, must provide all full names of the members of the group along with valid email addresses of the other group members. Our website will electronically forward them a copy of the terms of service for them to accept before hunt dates are confirmed.

Hunt Packages

3 day fully guided hunting packages $2750.00 USD plus 5% GST

  • Mon-Wed: 3 morning hunts - 2 evening hunts. Arrive at the lodge on Sunday afternoon - depart lodge Wednesday before noon.
  • Thurs.-Sat:   3 morning hunts - 2-evening hunts.  Arrive at the lodge on Wednesday afternoon - depart lodge Saturday before noon.

Included in the 3 day hunting packages:

  • 3 nights lodging
  • All required waterfowl hunting licenses
  • All meals, snack and non-alcoholic beverages
  • Top quality decoyand blinds (both layout and panel blinds)
  • Experienced guides, callers and bird spotters
  • Trained hunting dogs if required
  • Airport transportation to and from lodge at scheduled pickup and drop off times. If client/clients are not able to meet the scheduled pick up and drop off times provided by CNFO, we can schedule a separate pickup at additional charge if $125.00 for each trip. Additionally, the client/clients can make their own arrangements to arrive or depart the lodge at their own cost. Clients may also choose to rent their own vehicles and drive to and from the lodge (car rental is at the clients expense).

5 Day hunting fully guided package $4100.00 US$ plus 5% GST

  • 5 morning hunts and 4 evening hunts. Arrive at the lodge on Sunday afternoon - depart lodge Friday before noon.

Included in the 5 day fully guided hunting package:             

  • 4 nights lodging
  • All required waterfowl hunting licenses
  • All meals, snack and non-alcoholic beverages
  • Top quality decoy and blinds (both layout and panel blinds)
  • Experienced guides, callers and bird spotters
  • Trained hunting dogs if required
  • Airport transportation to and from lodge at scheduled pickup and drop off times. If client/clients are not able to meet the scheduled pick up and drop off times provided by CNFO, we can schedule a separate pickup at additional charge if $125.00 for each trip. Additionally, the client/clients can make their own arrangements to arrive or depart the lodge at their own cost. Excluded from all hunt packages

Gratuity/tipping

It is customary for each client/hunter to tip their guide, spotter, and cook while on a guided hunt with an outfitter. A standard tip amount is about 10-15% of the hunt cost, although any amount you can afford is greatly appreciated. Please let them know that their efforts and skills are appreciated. They will do everything in their power to make your trip as enjoyable as possible. All tips are split proportionally.

Bird cleaning

Arrangements can be made for bird cleaning, labeling, freezing (if time allows) and packaging of birds.

Ducks Plucked: $5.00 USD
Ducks Breast Plated $3.00 USD
Geese Plucked: $7.00 USD
Geese Breast Plated: $5.00 USD

  • Coolers can be purchased to transport your processed bird for $50.00 USD each.

  • Ammunition can be purchased at the lodge at current market rate. We will have most popular size 12 gauge 3” steel shot shells. Please let us know in advance if any special shot or different gauge requirement so we can try to accommodate your needs.
    Meals and hotel prior to and after your scheduled hunting package dates.  Ex: missed flights, connection delays or accidents are not included and not the responsibility of CNFO.
  • Hotel stay prior to and after the hunt may be required depending on travel plans. Some clients prefer doing so for relaxation purposes
  • Shotgun rental at $80.00 USD per day
  • Airfare or travel expenses to arrive to Alberta, Canada
  • Rates for ammunition and bird cleaning are subject to change; as they do we will post to our website and/or advise clients when they arrive

Deposits

A 50% deposit on all hunt packages per hunter is required to reserve the hunt you or your party chose and reserve the hunt dates. Hunt dates are not reserved UNTIL a deposit (or deposits) are received and a fully executed copy of the CNFO client agreement has been returned to CNFO. If reserving as a group, all group members executed CNFO client agreements must be returned to CNFO before hunt package and hunt dates are reserved.

The balance of the hunts package cost is due by July 1st of the hunting year. If balance of final hunt package payment is not received by July 1st of the scheduled hunt year, we will contact the client or client’s coordinator as a courtesy reminder. An email will be sent out. If no response or no remittance of balance is received within 7 days of receiving the courtesy reminder email, the hunt will be considered cancelled. No REFUND of deposit or deposits will occur. The hunt package and dates will then be available for other clients on our waiting list to reserve.

Cancellation Policy

All deposits are NON-REFUNDABLE. If for any reason you or your group is unable to fulfill your hunt and need to cancel your hunt, your deposit (or deposits) will be NON-REFUNDABLE. However, your deposit and/or either one or several of your group member’s deposits may be transferred to another open hunt the same hunt year OR carried over to the next hunting year, same hunt package as well as the same hunt dates. ONLY ONE CARRYOVER YEAR will be allowed. If, for any reason, the next hunt year will not work for you or your group, the deposits will be forfeited (for this reason CNFO strongly recommends that their clients purchase travel insurance - this is money well spent considering the total investment of the trip!!!), see below.

Refunds

CNFO reserves the right to cancel any hunts at any time, for any reason. If CNFO should have to cancel your or your group's hunt, it will fully refund all deposits and or payments made to CNFO. However it will not refund any amounts for client's travel or other expenses.

Entering Canada

Valid Passports are required at the border and all airports. Please checks with border services to make sure you or any member of you party is NOT denied entry to Canada before reserving your hunt package with CNFO.

It is the client’s responsibility to make sure you are not refused entry into Canada for any reason. The refusal of your or a group member’s entry into Canada by customs or immigrations will not be a reason for a refund from CNFO of the hunt packages costs.
If you have had criminal charges in your past, including a D.U.I., you may have problems entering Canada. These problems or concerns may take months to correct. We strongly advise that you call and clear up any matters well in advance of your hunt package dates of your planned visit to Canada.

A D.U.I. could prevent you from entering Canada- Please verify your entry into Canada before reserving a hunt package with CNFO.

Travel Insurance

CNFO strongly recommends travel insurance be purchased by our client or clients. These policies can protect you from uncontrollable and unfortunate circumstances that may disrupt your hunting trip. These types of policies are set up for sportsmen. They can cover such things as emergency evacuation, accidentals or medical expenses, trip cancellation, flight and baggage delay, etc. For the amount of money that these policy premiums cost, in relation to your total trip cost, it is money well spent.

Use of Credit/Debit Card

Credit card service exists solely for client convenience. All credit card sales are final; charges for deposits or balances are final; charges for deposits or balances shall be neither disputed nor refunded for any hunts or services rendered or forfeited due to cancellation or for any reason whatsoever (please refer to Our Cancellation Policy Herein).

Disputes

Governing Law and Dispute Resolution. The formation, construction, performance and enforcement of this Agreement shall be in accordance with the laws of the United States and the state of Colorado without regard to its conflict of law provisions or the conflict of law provisions of any other jurisdiction. In the event of a dispute arising out of this Agreement, the parties agree to attempt to resolve any dispute by negotiation between the parties. If they are unable to resolve the dispute, either party may commence mediation and/or binding arbitration through the American Arbitration Association, or other forum mutually agreed to by the parties. The prevailing party in any dispute resolved by binding arbitration or litigation shall be entitled to recover its attorneys' fees and costs. In all other circumstances, the parties specifically consent to the local, state and federal courts located in the state of Colorado. The parties hereby waive any jurisdictional or venue defenses available to them and further consent to service of process by mail. Client acknowledges that CNFO will have no adequate remedy at law in the event Client uses the deliverables in any way not permitted here under, and hereby agrees that CNFO shall be entitled to equitable relief by way of temporary and permanent injunction, and such other and further relief at law or equity as any arbitrator or court of competent jurisdiction may deem just and proper, in addition to any and all other remedies provided for herein.

Hunting

CNFO is committed to provide our clients with excellent hunting opportunities. However, we cannot guarantee any specific numbers of birds, shooting opportunities, or bag limits on any or all days of your hunt.  Even though Alberta, Canada is renowned for having arguably some of the best waterfowl hunting in Canada... "it is still hunting". Just like any migratory game birds, all hunts are subject to occasional inconsistencies and unforeseen circumstances. Therefore no refunds, full or partial, will be returned by CNFO. Because prices are based on scheduled packages, no refunds are made for any feature or service that you do not use. For this reason, we strongly recommend that you purchase trip cancellation insurance. Buying trip insurance is your only assurance against losing your investment due to unforeseen circumstances. CNFO will not be held responsible for refunding any money paid for hunt trips that are not productive or possibly due to adverse weather conditions (dense fog, heavy rain, thunderstorms, or very high winds).  The determination or whether or not a hunt can begin or continue due to weather rests solely with the outfitter and the guide. All clients will accept the outfitters/guides instruction and the decision is final, without reservation or evasion, protest, or argument. Any individual who attempts to interfere, intimidate, threaten or assault any member of CNFO’s staff will be subject to expulsion for the remainder of the trip WITHOUT REFUND. Your signature on the documents indicates your understanding an acceptance of this policy.

Photos and Media

CNFO reserves the right, without further notice, to make use of photographic images taken during the trip by our staff for general purposes without payment or permission. When a client makes available to CNFO photographs of their own, CNFO reserves the right to make use of such photographs in its online and print media with photographer credit provided if requested.

Refusal of Service

CNFO reserves the right to refuse service, or discontinue service at any time, to anyone, for any reason.

All policies regarding drugs, drunkenness, proper conduct, and gun safety will be strictly enforced. Violators are subject to immediate expulsion, without refund of any kind including unused days of the trip. The decision to expel a client, or clients, from the trip will be made by the outfitter and his or her decision is final. Your signature on this document indicates your understanding or acceptance of this protocol

Drugs and Alcohol

THE POSSESSION OR USE OF ILLEGAL DRUGS IS ILLEGAL, AND STRICLY PROHIBITED. We strongly recommend that no client attempt to bring a controlled substance into Canada, nor attempt to purchase while here. Drug enforcement is strong, and the punishments are SEVERE (mandatory prison sentences in most cases.) DO NOT RISK IT!  If illegal drugs or paraphernalia are discovered on the possession of a client, or clients, in the field or at the lodge, CNFO reserves the right to expel the client, or clients, from the remainder of the hunt package.  NO REFUND of any kind, including all remaining unused portions of the hunt will be issued. Your signature on this document indicates your understanding or acceptance of this protocol.

The consumption of alcoholic beverages while hunting is also prohibited - no exceptions. Any hunter determined to be intoxicated shall not be allowed to handle a firearm for 24 hours. Any client, or clients, who become belligerent, offensive, or dangerous as a result of drinking alcohol will be expelled from the remainder of the trip without refund of any kind, including all remaining unused portions of the hunt. Your signature on this document indicates your understanding an acceptance of this protocol.

Proper Conduct

Inappropriate and/or lewd behavior of any kind (example: severe intoxication, any groping of staff members, etc.) will not be tolerated. CNFO reserves the right to make the determination if any individual, or individuals, are behaving in an unacceptable, lewd, or obscene manner and make the final decision as to whether to counsel or expel the individual or individuals from the trip. Violators are subject to expulsion without refund of any kind including all remaining unused portions of the hunt package.  Your signature on this document indicates your understanding and acceptance of this protocol.

Safety

All clients will ensure that their guns are unloaded at the lodge, and during transportation. All clients will keep their actions open, and guns unloaded until instructed by the guides to load them. Safeties will remain on while loading and unloading, as well as between shots. All clients will follow the instructions set forth by our guides in the field regarding positioning and placement.

No clients shall fire a shot during a waterfowl hunt until the shot is called by the guide. Two warnings will be issued by the guide. After a third warning, any offender(s) will be subject to removal from the field for the rest of their day.

Additionally, no client shall point his/her gun in the direction of another person at any time. Additionally, at no time shall a client shoot over the body of a guide, another client of the group, nor at birds that are behind the decoys. Eye protection will be worn at all times in the hunting areas. Any unsafe operation of firearms constitutes inappropriate conduct, and is grounds for expulsion from the hunt package, without refund. Your signature on this document indicates your understanding and acceptance of this protocol.

Force Majeure

CNFO cannot be held liable for claims, losses, damages, costs, expenses, delays, loss of enjoyment, of any nature or kind whatsoever, to the traveler and/or traveling companions, resulting from events beyond CNFO’s control, including but not limited to acts of God, strikes, lockouts, or other labor disputes or disruptions, pandemic or local diseases, wars, blockades, insurrections, riots, earthquakes, weather conditions, floods, or laws, acts, or restraints imposed by government authorities.

I have read, and understand all of the content in the TERMS AND CONDITIONS. Therefore, I have no questions about this information and agree to comply with all content contained herein. I also understand that I may be asked to sign a Release and Waiver of Liability which will be delivered electronically along with a CNFO / client agreement after deposits are received by CNFO.
